A BILL to amend the Code of Virginia by adding a section numbered 18.2-210.1, relating to use of fraud or artifice to accomplish vote on union organization.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-210.1 as follows:

§18.2-210.1 Use of fraud, material artifice, trickery, or deception to accomplish vote on union organization.

Any person who causes or assists in causing a vote to be taken by non-union employees on whether to organize a union by (i) knowingly and intentionally failing to provide full and complete information regarding the consequences of a signature or a vote or an affirmation by another or (ii) fraud, material artifice, trickery, or deception, is guilty of a Class 1 misdemeanor.
