Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Article 15 of Chapter 1 of Title 33.1 a section numbered 33.1-223.2:26 as follows:

§33.1-223.2:26. Agreements with local governments to provide for highway median maintenance.

The Department may enter into an agreement with counties, cities, and towns whereby the county, city, or town assumes responsibility for maintenance of highway medians within its boundaries. Any such agreement shall be upon terms to which have been mutually agreed. No such agreement shall reduce the amount of state funds available to the Department of Transportation for maintenance of highway medians.
