Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 13.1 of Chapter 8 of Title 46.2 a section numbered 46.2-916.4 as follows:
§46.2-916.4. Use of certain utility vehicles on secondary roads.
Notwithstanding any other provision of law, a person with a valid driver's license and insurance may operate a utility vehicle that has been registered as an off-road vehicle on a secondary road of the Commonwealth in a county with a population of 100,000 or less, based on the most recent census report from the United States Census Bureau, if the utility vehicle is equipped with:
1. Side-by-side seating;
2. A protective roll bar;
3. A steering wheel;
4. Functioning head lights, tail lights, and brake lights;
5. A driver's side mirror;
6. A rear view mirror;
7. A horn; and
8. A muffler.
