12101809D Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding a section numbered 46.2-923.1 as follows: §46.2-923.1. Drivers to exercise due care. Notwithstanding the other provisions of this chapter, every driver of a motor vehicle shall exercise due care to avoid colliding with any pedestrian or the operator of a human-powered vehicle and shall give an audible signal when necessary. Every driver shall exercise proper precaution upon observing any child or any obviously confused, incapacitated, or intoxicated person on the highways. |
