Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 33.2-100.1 as follows:
§33.2-100.1. Use of transportation funds.
It is the policy of the Commonwealth that any revenues dedicated to funds in this title shall be used only for purposes of (i) financing, acquiring, constructing, improving, maintaining, and operating transportation systems in the Commonwealth and all purposes incidental thereto; (ii) furthering the interest of the Commonwealth in highways, public transportation, railways, seaports, spaceports, and airports physically located in or directly benefiting the Commonwealth; and (iii) providing for the operations of state agencies related to transportation. No source of revenue dedicated to a transportation purpose on or after July 1, 2019, nor any revenues that might accrue to a transportation-related fund in the State Treasury, shall be transferred or rededicated to a non-transportation purpose through general law or through a general appropriation act. Any such transfer or repurposing shall be deemed invalid and contrary to the policy stated herein, and shall not be effectuated.
