SENATE BILL NO. 794

AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to direct the Waste Management Board to develop guidance to collect, store, use, and recycle waste tires.

Be it enacted by the General Assembly of Virginia:

1. § 1. That the Waste Management Board (the Board) shall develop guidance by October 1, 2025, to enable statewide collection, storage, recycling, and waste-to-energy use of waste tires from vehicles that reduce the disposal of such tires in landfills and the stockpiling of such tires by 90 percent by 2027. In developing the guidance, the Board shall consider incorporating any U.S. Environmental Protection Agency regulations and funding opportunities. Such guidelines shall include a recommended enhanced fine for any person that improperly disposes a waste tire in the waters of the Commonwealth. All agencies of the Commonwealth, including a baccalaureate public institution of higher education, as that term is defined in § 23.1-100 of the Code of Virginia, shall provide technical assistance to the Board upon request. The Board shall report its recommendations on the enhanced fine for improper disposal of waste tires in the waters of the Commonwealth to the Chairmen of the Senate Committee on Agriculture, Conservation and Natural Resources and the House Committee on Agriculture, Chesapeake and Natural Resources by December 1, 2025.
