AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee for Courts of Justice
on January 17, 2018)

A BILL to amend the Code of Virginia by adding a section numbered 18.2-132.2, relating to release of hunting dogs on a highway; penalty.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-132.2 as follows:

§18.2-132.2. Release of hunting dogs on highway; penalty.

Any person who intentionally releases one or more hunting dogs on or within 15 feet of a highway, as defined in §46.2-100, for purposes of hunting game is guilty of a Class 3 misdemeanor, unless the release of such dogs occurs on or within 15 feet of a highway that is adjacent to property whose landowner, or whose landowner's agent, has given the person releasing such dogs permission to hunt.  A second or subsequent violation of this section within three years is a Class 1 misdemeanor, and, upon conviction, the court shall revoke such person's hunting license for a period of one year.
