A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-5-31, all relating to requiring the Bureau of Medical Services to apply for waiver.
Be it enacted by the Legislature of West Virginia:
ARTICLE 5. MISCELLANEOUS PROVISIONS.
§9-5-31. Medicaid program; Buy-in plan.
By July 1, 2024, the Bureau of Medical Services shall apply to the Centers for Medicare & Medicaid Services for a Basic Health Plan Option under Section 1331 and/or a State Innovation Waiver under Section 1332 of the Patient Protection and Affordable Care Act. The department shall maximize all available federal dollars for the waiver.
NOTE: The purpose of this bill is to require the Bureau of Medical Services to apply for waiver.
