A BILL to amend and reenact §55-19-7 of the Code of West Virginia, 1931, as amended, relating to the removing the protection of the Act from employers that require vaccinations as a condition of employment.
Be it enacted by the Legislature of West Virginia:
ARTICLE 19. COVID-19 JOBS PROTECTION ACT.
§55-19-7. Exception.
Exceptions.
(a) Excluding the provisions of §55-19-5 and §55-19-6 of this code, the limitations on liability provided in this article shall not apply to any person, or employee or agent thereof, who engaged in intentional conduct with actual malice.
(b) The limitations on liability provided in this article shall not apply to any employer that requires, as a condition of employment, its employees be vaccinated.
NOTE: The purpose of this bill is to except from coverage by Act employers that require vaccinations as a condition of employment.
