A BILL to amend and reenact §64-2-1 of the Code of West Virginia, 1931, as amended, relating to authorizing the State Board of Risk and Insurance Management to promulgate a legislative rule relating to procedures for providing written notification of claims of potential liability to the state or its employees.
Be it enacted by the Legislature of West Virginia:
ARTICLE 2. Authorization for Department of administration to promulgate legislative rules.
§64-2-1. State Board of Risk and Insurance Management.
The legislative rule filed in the State Register on August 18, 2020, authorized under the authority of §29-12-5 of this code, relating to the State Board of Risk and Insurance Management (procedures for providing written notification of claims of potential liability to the state or its employees, 115 CSR 05), is authorized.
NOTE: The purpose of this bill is to authorize the State Board of Risk and Insurance Management to promulgate a legislative rule relating to procedures for providing written notification of claims of potential liability to the state or its employees. The rule, as amended, strikes the contents of the entire rule; BRIM states that it is intending to repeal the rule.
