AN ACT

 

AMENDING TITLE 12, CHAPTER 13, Arizona Revised Statutes, BY ADDING ARTICLE 11; RELATING TO UNMANNED AERIAL VEHICLE EVIDENCE.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 12, chapter 13, Arizona Revised Statutes, is amended by adding article 11, to read:

ARTICLE 11.  UNMANNED AERIAL VEHICLE EVIDENCE

START_STATUTE12-2331.  Admissibility of pictures or information; definition

A.  Any picture or information that is obtained or collected without a search warrant by an unmanned aerial vehicle is inadmissible in any court in this state.

B.  For the purposes of this section, "unmanned aerial vehicle" means a powered aerial vehicle that:

1.  does not carry a human operator.

2.  Uses aerodynamic forces to provide vehicle lift.

3.  Can fly autonomously or be piloted remotely.

4.  Can be expendable or recoverable.

5.  Can carry a lethal or nonlethal payload.  END_STATUTE
