AN ACT

 

Amending title 34, Arizona Revised Statutes, by adding chapter 7; relating to public improvements.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 34, Arizona Revised Statutes, is amended by adding chapter 7, to read:

CHAPTER 7

MATERIALS FOR PUBLIC BUILDINGS OR IMPROVEMENTS

ARTICLE 1.  GENERAL PROVISIONS

START_STATUTE34-701.  Definitions

In this article, unless the context otherwise requires:

1.  "Public body" means this state, A city, town, county, school district, special district or other political subdivision of this state or any department, agency, board, commission, institution or governmental instrumentality of or within this state or a political subdivision of this state.

2.  "Suitable piping material" means piping material to which both of the following apply:

(a)  The material meets or exceeds the standards issued by the American society for testing and materials or the American water works association.

(b)  The material meets the specifications of the project for which it is being used. END_STATUTE

START_STATUTE34-702.  Preference of piping materials; prohibition; exception

A public body may not prefer one type of suitable piping material over another in constructing, developing, maintaining, rebuilding, improving, repairing or operating a water, wastewater or storm water drainage project that is funded in whole or in part with state monies, unless sound engineering practices suggest that one type of suitable piping material is more appropriate for a particular project.
