HOUSE BILL 2759

 

 

 

 

An Act

 

amending title 15, chapter 14, article 14, Arizona Revised Statutes, by adding section 15-1899.01; relating to institutions of higher education.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 15, chapter 14, article 14, Arizona Revised Statutes, is amended by adding section 15-1899.01, to read:

START_STATUTE15-1899.01. Student groups; support of foreign terrorist organizations; prohibition; definitions

A. Notwithstanding any other law, an institution of higher education may not Formally recognize a student organization that does any of the following:

1. provides material support to a foreign terrorist organization, including a foreign terrorist organization that calls for genocide against the Jewish people.

2. Vocally supports, calls for or advocates for genocide, including genocide against the Jewish people.

3. Promotes a foreign terrorist organization in any manner that places a Jewish student in reasonable apprehension of imminent physical injury.

4. Promotes a foreign terrorist organization on the student organization's official social media accounts or communication platforms.

5. Engages in activities that manifest evidence of prejudice based on antisemitism.

B. Each institution of higher education shall:

1. Enforce the institution of higher education's codes of conduct, including provisions regarding violent speech on campus.

2. Fully investigate the activities of any student organization that has been reported for a potential violation of 18 United States Code section 2339A or 2339B or any state law relating to supporting a foreign terrorist organization.

3. Require the faculty advisor of each formally recognized student organization to report any violation of paragraph 2 of this subsection.

4. Discipline any faculty advisor who knowingly violates the requirement prescribed in paragraph 3 of this subsection.

5. Rescind formal recognition of any student organization that the institution of higher education determines has violated paragraph 2 of this subsection.

C. For the purposes of this section:

1. "Antisemitism" has the same meaning prescribed in section 41-1750.

2. "foreign terrorist organization" means a foreign terrorist organization designated by the united states secretary of state pursuant to 8 united states code section 1189.

3. "Institution of higher education" means both:

(a) A university under the jurisdiction of the Arizona board of regents.

(b) A community college as defined in section 15-1401.END_STATUTE
