AN ACT

 

Amending title 36, chapter 29, article 1, Arizona Revised Statutes, by adding section 36-2903.09; relating to the ARizona health care cost containment system.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 29, article 1, Arizona Revised Statutes, is amended by adding section 36-2903.09, to read:

START_STATUTE36-2903.09.  Health care professionals; pharmacists; AHCCCS members; controlled substance monitoring

A.  A health care professional who is authorized to prescribe medications pursuant to title 32 shall check the database developed under the controlled substances prescription monitoring program established pursuant to section 36‑2602 before prescribing a controlled substance to a member.  This subsection does not apply to a board‑eligible or board‑certified oncologist or hematologist who is prescribing a medically necessary controlled substance to a patient for the treatment of pain associated with cancer or progressive sickle cell disease. 

B.  A pharmacist who is licensed pursuant to title 32, chapter 18 and who is a provider under this article shall check the database developed under the controlled substances prescription monitoring program established pursuant to section 36‑2602 before filling a prescription for a controlled substance for a member.
