AN ACT

 

providing for a world war ii memorial in wesley bolin plaza.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  World War II memorial; procedures

A.  Pursuant to section 41-1363, subsection A, Arizona Revised Statutes, this act authorizes the department of administration to provide for the placement in the Wesley Bolin plaza of a memorial dedicated to the memory of the commencement of World War II at Pearl Harbor on December 7, 1941 and the signing of the surrender by Japan on September 2, 1945.  The secretary of state is the proponent of the memorial.

B.  The procedures and requirements prescribed in section 41-1363, subsection B, paragraphs 1, 2, 3, 4 and 6 and subsections D and F, Arizona Revised Statutes, and section 41‑1364, subsection A, paragraphs 1 and 2, Arizona Revised Statutes, apply to the memorial.

C.  The secretary of state may solicit and accept contributions, including in-kind contributions, to pay for the costs of the memorial.  Monies received by the secretary of state for this purpose shall be placed in a separate account pursuant to section 35-142, Arizona Revised Statutes.

D.  The secretary of state is not required to deposit monies in the state monument and memorial repair fund established by section 41‑1365, Arizona Revised Statutes, for the World War II memorial.  The secretary of state may enter into an interagency service agreement with the department of administration for the maintenance, repair, reconditioning or relocation of the memorial. 

Sec. 2.  Intent

It is the intent of the legislature that the costs of the World War II memorial be paid solely with contributions, including in‑kind contributions. If the Secretary of State expends any monies from any source other than contributions accepted for the memorial pursuant to section 1, subsection C of this act, it is the intent of the legislature that those monies be reimbursed as soon as practicable from the contributions accepted.

Sec. 3.  Delayed repeal

This act is repealed from and after September 30, 2014.

Sec. 4.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
