SENATE BILL 1190

 

 

 

An Act

 

amending sections 15-1447 and 28-2412, Arizona Revised Statutes; relating to special plates.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 15-1447, Arizona Revised Statutes, is amended to read:

START_STATUTE15-1447. Community college district collegiate special plate funds; purpose

A. A community college district with a full-time equivalent student enrollment pursuant to section 15-1466.01 of more than fifty thousand five hundred students shall establish a community college district collegiate special plate fund consisting of monies received pursuant to section 28-2412.  The district shall administer the fund. All monies in the fund shall be used only for academic scholarships.

B. The fund established in pursuant to this section is exempt from section 35-190 relating to lapsing of appropriations. At the direction of the community college district, the state treasurer may invest and divest inactive monies in the fund as provided by section 35-313. The state treasurer shall credit all interest earned on the fund monies to the fund. END_STATUTE

Sec. 2. Section 28-2412, Arizona Revised Statutes, is amended to read:

START_STATUTE28-2412. Collegiate special plates; definition

A. Except as otherwise provided in this subsection, the department shall issue collegiate special plates that identify each university that is described in section 15-1601 or each community college district. The collegiate special plates shall have the same color and design as the collegiate license plates issued on or before December 31, 1992, except that on the request of a university as described in section 15-1601 or a community college district, the department may revise the color and design of the plates as appropriate for the university or community college district.  Beginning from and after the effective date of this amendment to this section, the department may issue collegiate special plates for a community college district only if a person pays $32,000 to the department for the implementation of a collegiate special plate for the community college district.  The person that pays the $32,000 for the implementation of the collegiate special plate for a community college district shall design the collegiate special plate for the community college district.  The design and color of the collegiate special plates are subject to the approval of the department.

B. Of the twenty-five dollar $25 fee required by section 28-2402 for original special plates and for renewal of special plates, eight dollars $8 is a special plate administration fee and seventeen dollars $17 is a collegiate plate annual donation.

C. The department shall deposit, pursuant to sections 35-146 and 35-147, all special plate administration fees in the state highway fund established by section 28-6991 and shall transmit the collegiate plate annual donations as follows:

1. To the Arizona board of regents for placement in the appropriate university collegiate special plate fund.

2. To the community college district collegiate special plate fund established by pursuant to section 15-1447.

D. The request for collegiate special plates may be combined with a request for personalized special plates. This request shall be on a form prescribed by the director and is subject to the fees required for the personalized special plates in addition to the fees required for collegiate special plates.

E. For the purposes of this section, "community college district" means a community college district that includes all of the following:

1. Is established pursuant to sections 15-1402 and 15-1403 or section 15-1402.01.

2. Is a political subdivision of this state.

3. Has a full-time equivalent student enrollment pursuant to section 15-1466.01 of more than fifty thousand five hundred students. END_STATUTE
