SENATE BILL 1190

 

 

AN ACT

 

Amending section 43-1086, Arizona Revised Statutes; Amending laws 2008, chapter 243, section 6; amending Laws 2010, chapter 254, section 2, as amended by Laws 2011, chapter 126, section 2 and chapter 307, section 6; relating to the military family relief fund.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 43-1086, Arizona Revised Statutes, is amended to read:

START_STATUTE43-1086.  Credit for donation to the military family relief fund

A.  For taxable years beginning from and after December 31, 2007 through December 31, 2012 2018, a credit is allowed against the taxes imposed by this title for cash contributions made by a taxpayer during the taxable year to the military family relief fund established by section 41‑608.04.  The amount of the credit is the lowest of the following amounts, as applicable:

1.  The total amount of contributions to the fund by the taxpayer during the taxable year.

2.  Two hundred dollars of contributions during the taxable year by a taxpayer filing as a single individual or a head of household.

3.  Four hundred dollars of contributions during the taxable year by a married couple filing a joint return.

4.  The taxpayer's tax liability for the taxable year.

B.  A husband and wife who file separate returns for a taxable year in which they could have filed a joint return may each claim only one-half of the tax credit that would have been allowed on a joint return. END_STATUTE

Sec. 2.  Laws 2008, chapter 243, section 6 is amended to read:

Sec. 6.  Delayed repeal

A.  Section 41-608.04, Arizona Revised Statutes, is repealed from and after December 31, 2013 2018.

B.  Section 43-1086, Arizona Revised Statutes, is repealed from and after December 31, 2012 2018.

Sec. 3.  Laws 2010, chapter 254, section 2, as amended by Laws 2011, chapter 126, section 2 and chapter 307, section 6, is amended to read:

Sec. 2.  Military family relief fund; grant awards

Notwithstanding section 41-608.04, Arizona Revised Statutes, and through December 31, 2012 2018, the military family relief fund advisory committee may:

1.  Use monies in the military family relief fund to provide financial assistance to an applying family if the service member of the family was deployed to a combat zone after September 11, 2001.

2.  Award up to twenty thousand dollars to an applying family if two‑thirds of the members of the committee agrees to recommend approval of the grant at a meeting of the entire committee.
