BILL NUMBER: AB 1191 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Huber FEBRUARY 18, 2011 An act to repeal Section 50075.5 of the Public Utilities Code, relating to transportation. LEGISLATIVE COUNSEL'S DIGEST AB 1191, as introduced, Huber. San Joaquin Regional Transit District. Existing law creates the San Joaquin Regional Transit District to operate public transit services in the Stockton Metropolitan Area, as defined, and the remainder of San Joaquin County. Existing law requires all new intercity, interregional, and rural services provided outside the Stockton Metropolitan Area to be open to competitive bidding at least once every 5 years, and provides that the district may be one of the bidders. Existing law requires the contract for service to be let to the lowest responsible bidder, and authorizes the board of the district to reject any and all bids and readvertise the contract. This bill would repeal these competitive bidding requirements. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 50075.5 of the Public Utilities Code is repealed.50075.5. All new intercity, interregional, and rural services provided outside the Stockton Metropolitan Area shall be subject to open competitive bidding at least once every five years. For the bidding, the district may be one of the bidders. The district shall cause notice inviting bids to be published at least once in a newspaper of general circulation within San Joaquin County, which publication shall be made at least 10 days before bids are to be received. The contract for service shall be let to the lowest responsible bidder. The board may reject any and all bids and may readvertise in its discretion.
