An act to amend Section 11999.25 of the Health and Safety Code, relating to substance abuse.

AB 1325, as introduced, Waldron.
Substance abuse testing and treatment.
Existing law, as added by the Substance Abuse and Crime Prevention Act of 2000, adopted by voters as Proposition 36 at the November 7, 2000, statewide general election, requires that persons convicted of certain nonviolent drug possession offenses be granted probation and participate in and complete an appropriate drug treatment program as a condition of that probation.
Existing law, until July 1, 2013, required the State Department of Alcohol and Drug Programs, now consolidated into the State Department of Health Care Services, to administer and award grants to counties, based on an approved plan, to supplement funding provided under the above-described act for the purpose of funding substance abuse testing for eligible offenders. Existing law required a county plan to include a description of the process to be used for substance abuse testing
and substance abuse treatment of probationers and parolees, as specified.
This bill would make technical, nonsubstantive changes to one of those provisions.

The people of the State of California do enact as follows:
SECTION 1.
Section 11999.25 of the Health and Safety Code is amended to read:11999.25.
(a) To be eligible for a grant pursuant to this division, a county shall have on file with the State Department of Alcohol and Drug Programs an approved plan for implementing the Substance Abuse and Crime Prevention Act of 2000.(b) The county plan shall include a description of the process to be used for substance abuse treatment and substance abuse testing of probationers consistent with Sections 1210.1 and 1210.5, 1210.5 of the Penal Code, and substance abuse treatment and substance abuse testing of parolees consistent with Sections 3063.1 and 3063.2.
3063.2 of the Penal Code.
(c) The State Department of Alcohol and Drug Programs shall establish a fair and equitable distribution formula for allocating money to eligible counties.
(d) This section shall become inoperative on July 1, 2013.
