An act to amend Section 12921.2 of the Insurance Code, relating to insurance.

Existing law generally regulates insurance and creates the Department of Insurance, headed by the Insurance Commissioner. Existing law requires all public records of the department and the commissioner that are subject to disclosure under the California Public Records Act to be available for inspection and copying, as specified, at the offices of the department in the San Francisco Bay area, in the City of Los Angeles, and in the City of Sacramento.

This bill would eliminate the reference to an office in the San Francisco Bay area and instead refer to the department’s offices in the City of Oakland, the City of Los Angeles, and the City of Sacramento. The bill would remove an obsolete cross-reference.

The people of the State of California do enact as follows:

SECTION 1.

Section 12921.2 of the Insurance Code is amended to read:

12921.2.

All public records of the department and the commissioner subject to disclosure under Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government Code shall be available for inspection and copying pursuant to those provisions at the offices of the department in the ~~San Francisco Bay area, in~~ City of Oakland, the City of Los Angeles, and in the City of Sacramento. Adequate copy facilities for this purpose shall be made available. Notwithstanding any other law, a person requesting copies of these records shall receive the copies from employees of the department and the fee charged for the copies shall not exceed the actual cost of producing the copies. ~~Notwithstanding Section 6256 of the Government Code, a~~ A public record submitted to the department as computer data on an electronic medium shall, in addition to other formats, be made available to the public pursuant to this section through an electronic medium.
