   An act to amend Section 31840.7 of the Government Code, relating
to county employees' retirement.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 1885, Bonilla. County employees' retirement: reciprocal
benefits.
   Under existing law, counties and districts, as defined, may
provide retirement benefits to their employees pursuant to the County
Employees Retirement Law of 1937. Existing law provides for
reciprocity of retirement benefits, as specified, to a member of a
county retirement system by reason of his or her membership in
another specified public retirement system, as specified. Existing
law provides that wherever the reciprocal rights of a member of a
county retirement system are conditioned upon reemployment within a
specified period after termination of employment covered by another
retirement system, the period shall be one year in the case of any
member who was reemployed on or after January 1, 1989, and whose
termination of employment was due to layoff because of, a lack of
work, a lack of funds, or a reduction in workforce. Existing law
prohibits that one-year reemployment provision from being operative
in any county until the board of supervisors, by resolution adopted
by a majority vote, makes the provision applicable in that county.
   This bill would make that one-year reemployment provision
applicable in all counties.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 31840.7 of the Government Code is amended to
read:
   31840.7.  Wherever in this chapter the rights of a member, because
of membership in another retirement system, are conditioned upon
reemployment within a specified period after termination of
employment covered by a system under this chapter or another
retirement system, the period shall be one year in the case of any
member who was reemployed on or after January 1, 1989, and whose
termination of employment was due to layoff because of a lack of
work, a lack of funds, or a reduction in workforce.
