BILL NUMBER: AB 1891 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Wagner FEBRUARY 22, 2012 An act to add and repeal Section 25228 of the Public Resources Code, relating to energy. LEGISLATIVE COUNSEL'S DIGEST AB 1891, as introduced, Wagner. Energy: nuclear energy: study. The California Global Warming Solutions Act of 2006 requires the State Air Resources Board to adopt greenhouse gas emission limits and emission reduction measures by regulation to achieve the maximum technologically feasible and cost-effective reduction in greenhouse gas emissions to achieve the statewide greenhouse gas emissions limit. Existing law prohibits a load-serving entity and local publicly owned electric utility from entering into a long-term financial commitment unless the baseload generation complies with a greenhouse gases emission performance standard established by the State Air Resources Board. This bill would require the State Resources Conservation and Development Commission, on or before an unspecified date, to perform and submit to the Legislature a report on how electrical utilities can meet the consumer demand for electricity consistent with the above greenhouse gas emission standards. The bill would require the commission to consider and make recommendations on the role nuclear energy may serve in meeting these standards. The bill would be repealed by its own provisions on an unspecified date. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 25228 is added to the Public Resources Code, to read: 25228. (a) On or before ____, the commission shall perform and submit a report to the Legislature on how electrical utilities can meet the consumer demand for electricity consistent with the greenhouse gas emission standards established pursuant to the California Global Warming Solutions Act of 2006 (Division 25.5 (commencing with Section 38500) of the Health and Safety Code) and Chapter 3 (commencing with Section 8340) of Division 4.1 of the Public Utilities Code. (b) The study performed pursuant to subdivision (a) shall consider and make recommendations on the role nuclear energy may serve in meeting the standards of the California Global Warming Solutions Act of 2006 (Division 25.5 (commencing with Section 38500) of the Health and Safety Code) and Chapter 3 (commencing with Section 8340) of Division 4.1 of the Public Utilities Code. (c) (1) The report submitted pursuant to subdivision (a) shall be submitted in compliance with Section 9795 of the Government Code. (2) Pursuant to Section 10231.5 of the Government Code, this section is repealed on ____.
