BILL NUMBER: AB 2425 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Hagman FEBRUARY 19, 2010 An act to add Section 65584.9 to the Government Code, relating to land use. LEGISLATIVE COUNSEL'S DIGEST AB 2425, as introduced, Hagman. Land use: City of La Habra Heights: regional housing need allocation. The Planning and Zoning Law requires each city and county to adopt a general plan that contains certain mandatory elements, including a housing element that is required to identify adequate sites for housing and to make adequate provision for the existing and projected needs of all economic segments of the community. That law requires the Department of Housing and Community Development, in consultation with each council of governments, to determine each region's existing and projected regional housing need, as specified, and also requires the council of governments to adopt a final regional housing need plan that allocates a share of the regional housing need for all income levels to each city or county, as specified. This bill would exempt the City of La Habra Heights, in its next housing element planning period, from the allocation of regional housing need. This bill would make legislative findings and declarations as to the necessity of a special statute for the City of La Habra Heights. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 65584.9 is added to the Government Code, to read: 65584.9. Notwithstanding any contrary law, the City of La Habra Heights, in its next housing element planning period after the effective date of the act that added this section, shall be exempt from the allocation of regional housing need. SEC. 2. The Legislature finds and declares that a special law is necessary and that a general law cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the unique lack of availability of locations for affordable housing within the City of La Habra Heights.
