   An act to  amend Section 120340   add Chapter
3.5 (commencing with Section 101800) to Part 4 of Division 101 
of the Health and Safety Code, relating to public health.

   AB 2546, as amended, Salas.  Childhood immunization.
  Kern County Hospital Authority.  
   Existing law authorizes the board of supervisors of certain
counties to establish a hospital authority for the management,
administration, and control of certain medical facilities.  

   This bill would authorize the board of supervisors of the County
of Kern to establish the Kern County Hospital Authority by reaching
an agreement with at least one health care facility and adopting an
ordinance.  
   Existing law prohibits the governing authority of a school or
other institution from unconditionally admitting any person as a
pupil of any private or public elementary or secondary school, child
care center, day nursery, nursery school, family day care home, or
development center, unless prior to his or her first admission to
that institution he or she has been fully immunized against various
diseases, including hepatitis B, pertussis (whooping cough), and
varicella (chickenpox), and any other disease deemed appropriate by
the State Department of Public Health, taking into consideration the
recommendations of specified entities. Existing law authorizes a
person who is not fully immunized to be admitted by the governing
authority of the facility on the condition that, within the time
period set by departmental regulations, he or she has been fully
immunized.  
   This bill would make technical, nonsubstantive changes to these
provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Chapter 3.5 (commencing with Section
101800) is added to Part 4 of Division 101 of the   Health
and Safety Code   , to read:  
      CHAPTER 3.5.  KERN COUNTY HOSPITAL AUTHORITY


   101800.  (a) The board of supervisors of the County of Kern may
establish the Kern County Hospital Authority, which shall for all
purposes be a public entity separate and apart from the county and
any other public entity. The authority established pursuant to this
chapter shall file the statement required by Section 53051 of the
Government Code, and shall be considered a public entity for purposes
of Division 3.6 (commencing with Section 810) of Title 1 of the
Government Code.
   (b) (1) In order for the authority to be established, transact any
business, exercise its powers, or undertake its duties and
responsibilities, the board of supervisors of the County of Kern and
the governing body of at least one health care facility shall reach
an agreement, on terms and conditions satisfactory to the parties,
regarding the affiliation or consolidation.
   (2) An agreement concerning the transfer of existing employees
from the county to the authority shall include a transition plan that
recognizes and ensures employee protections.
   (3) If the board of supervisors of the County of Kern and the
governing body of at least one health care facility reach an
agreement, the terms and conditions of the agreement shall be binding
upon the authority. After the agreement is reached, the board of
supervisors of the County of Kern shall adopt an ordinance to
establish the authority and authorize the authority to exercise its
powers and duties, and the board of supervisors and the governing
board shall appoint a board of trustees.  
  SECTION 1.    Section 120340 of the Health and
Safety Code is amended to read:
   120340.  A person who has not been fully immunized against one or
more of the diseases listed in Section 120335 may be admitted by the
governing authority on condition that, within time periods designated
by regulation of the department, he or she presents evidence that he
or she has been fully immunized against all of the diseases listed
in subdivision (b) of Section 120335.
