   An act to amend Section 111 of the Business and Professions Code,
relating to the Department of Consumer Affairs.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2638, as introduced, Chau. The Department of Consumer Affairs.
   Under existing law, the Department of Consumer Affairs is
comprised of boards that license and regulate various professions and
vocations. Existing law provides that these boards are established
to ensure that private businesses and professions are regulated to
protect the people of this state. Under existing law, any board has
the authority to appoint commissioners on examination, to give the
whole or any portion of any examination, as specified.
   This bill would make a technical, nonsubstantive change to that
provision.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 111 of the Business and Professions Code is
amended to read:
   111.  Unless otherwise expressly provided, any board may, with the
approval of the appointing power, appoint qualified persons, who
shall be designated as commissioners on examination, to give the
whole or any portion of any examination. A commissioner on
examination need not be a member of the board but he  or she
 shall have the same qualifications as one and shall be subject
to the same rules.
