An act to amend Section 90 of the Streets and Highways add Section 99167 to the Public Utilities Code, relating to transportation.

AB 3214, as amended, Mike Fong. Department of Transportation: state highways. Public transit: advertising.
Existing law creates various transit districts with specified powers and duties related to providing public transit services.
This bill would require the state, to the extent feasible, to prioritize using advertising space offered by a public transit operator over other advertising space for a public awareness campaign, as specified.

Existing law establishes the Department of Transportation and the California Transportation Commission and provides that the department has full possession and control of all state highways and all property and rights in property acquired for state highway purposes and authorizes and directs the department to lay out and construct all state highways between the termini designated by law and on the locations as determined by the commission.

This bill would make nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:


SECTION 1.

 The Legislature finds and declares all of the following:
(a) Public awareness campaigns are arguably the most effective communication method the government possesses for the widespread dissemination of information and education to its citizens.
(b) Matters deemed of significant importance are frequently shared with the public using public funds through a variety of advertising assets. Advertising space offered by public transit operators are among the most effective to reach all demographics because public transit systems are demand responsive and built to go where people go.
(c) Directing public funds for public awareness campaigns to public transit operators is a critical reinvestment in the public transit system as a large portion of the advertising revenue goes directly back to the public transit operator.
(d) Considering the budgetary challenges that historically plague public transit operators, the direction of public awareness campaigns towards advertising space offered by public transit operators is warranted to assist in keeping public transit systems running efficiently and safely, and to keep fares as low as possible.

SEC. 2.

 Section 99167 is added to the Public Utilities Code, to read:

99167.
 To the extent feasible, the state shall prioritize using advertising space offered by a public transit operator over other advertising space for a public awareness campaign unless the stated objective of the public awareness campaign cannot be fulfilled exclusively by using advertising space offered by a public transit operator.

SECTION 1.Section 90 of the Streets and Highways Code is amended to read:
90.

The Department of Transportation shall have full possession and control of all state highways and all property and rights in property acquired for state highway purposes. The department is authorized and directed to lay out and construct all state highways between the termini designated by law and on the locations as determined by the California Transportation Commission.
