An act relating to artificial intelligence.

AB 331, as introduced, Bauer-Kahan. Artificial intelligence.
Existing law establishes within the Government Operations Agency the Department of Technology, which is supervised by the Director of Technology. Existing law authorizes the director and the department to exercise various powers in creating and managing the information technology policy of the state.
Existing law, the California Fair Employment and Housing Act, protects and safeguards the right and opportunity of all persons to seek, obtain, and hold employment without discrimination, abridgment, or harassment on account of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, genetic information, marital status, sex, gender, gender identity, gender expression, age, sexual orientation, reproductive health decisionmaking, or veteran or military status.
This bill would state the intent of the Legislature to enact legislation relating to the use of artificial intelligence in accordance with prescribed principles relating to safety and effectiveness, algorithmic discrimination, notice and explanation of use, and human alternatives, consideration, or fallback.

The people of the State of California do enact as follows:


SECTION 1.

 It is the intent of the Legislature to enact legislation, entitled “The Artificial Intelligence Act,” relating to the use of artificial intelligence in accordance with principles relating to the following:
(a) Safe and effective systems.
(b) Algorithmic discrimination.
(c) Notice and explanation for the use of an automated system.
(d) Human alternatives, consideration, and fallback.
