An act to amend Section 14212 of the Elections Code, relating to elections.

LEGISLATIVE COUNSEL'S DIGEST

AB 363, as introduced, Gonzalez. Elections: polling places.

Existing law requires the polls to be open from 7 a.m. until 8 p.m. on the day of an election, except as specified.

This bill would require local elections officials to also provide for at least one polling place to be open for a minimum of 8 hours per day on the Saturday, Sunday, and Monday preceding an election, as specified.

By imposing new duties on local elections officials, this bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.

The people of the State of California do enact as follows:

SECTION 1.

 Section 14212 of the Elections Code is amended to read:

14212.

 (a) The polls shall be open at 7 a.m. of the day of any an election, and shall be kept open until 8 p.m. of the same day, when the polls shall be closed, except as provided in Sections 4005, 4007, and 14401.

(b) For every 10,000 registered voters within the jurisdiction where the election is held, as determined on the 88th day before the day of the election, the local elections official shall provide for at least one polling place to be open, for a minimum of eight hours per day, on the Saturday, Sunday, and Monday preceding an election. This subdivision shall not apply to jurisdictions conducting all-mailed ballot elections.

If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
