An act to amend Section 50 of the Harbors and Navigation Code, relating to harbors and navigation.

AB 748, as introduced, Villapudua. Division of Boating and Waterways.
Existing law establishes the Division of Boating and Waterways in the Department of Parks and Recreation, and prescribes the powers, functions, and jurisdiction of the division.
This bill would make nonsubstantive changes in the provision establishing the division.

The people of the State of California do enact as follows:


SECTION 1.

 Section 50 of the Harbors and Navigation Code is amended to read:

50.
 (a) The Department of Harbors and Watercraft and its successor, the Department of Navigation and Ocean Development, and the Department of Boating and Waterways are continued in existence in the Department of Parks and Recreation as the Division of Boating and Waterways. The Division of Boating and Waterways is the successor to, and is vested with, the powers, functions, and jurisdiction of all of the following state departments and agencies as hereinafter specified:
(1) All of the powers, functions, and jurisdiction previously vested in the Division of Small Craft Harbors of the Department of Parks and Recreation.
(2) All of the powers, functions, and jurisdiction of the State Lands Commission with respect to the acquisition, construction, development, improvement, maintenance, and operation of small craft harbors.
(3) All of the powers, functions, and jurisdiction of the Department of Parks and Recreation with respect to boating facility planning, design, and construction, except as specifically provided with respect to boating trails in the California Recreational Trails Act (Article 6 (commencing with Section 5070 5070) of Chapter 1 of Division 5 of the Public Resources Code) and in Article 2.6 (commencing with Section 68) of this chapter.
(4) All of the powers, functions, and jurisdiction of the Office of Architecture and Construction in the Department of General Services with respect to boating facility planning and design.
(5) All of the powers, functions, and jurisdiction of the Department of Water Resources with respect to beach erosion control.
(6) All of the policymaking and regulatory powers, functions, and jurisdiction of the Harbors and Watercraft Commission as to matters within the jurisdiction of the department. Division of Boating and Waterways.
(b) Regulations adopted by the former Department of Boating and Waterways shall remain in effect until revised or repealed by the Division of Boating and Waterways.
