BILL NUMBER: AB 884 INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Swanson FEBRUARY 26, 2009 An act relating to criminal procedure. LEGISLATIVE COUNSEL'S DIGEST AB 884, as introduced, Swanson. Probation and parole. Existing law provides for the granting of probation and parole to specified offenders under specified circumstances. This bill would provide that it is the intent of the Legislature to craft legislation that will amend the Penal Code to reduce unnecessary probation, parole, and jail time arising from certain probation and parole violations by nonviolent offenders. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. (a) The Legislature finds and declares all of the following: (1) The Penal Code of this state mandates the granting of probation and parole in far more instances than do the laws of other states. (2) Probation and parole violations in this state result in jail time in far more instances than is common in other states. (3) In order to reduce unnecessary incarceration and recidivism, the Penal Code should be revised to minimize the granting of probation and parole and to reduce the jail time imposed for specified probation and parole violations, particularly for nonviolent offenses. (b) It is the intent of the Legislature to craft legislation that will amend the Penal Code to reduce unnecessary probation, parole, and jail time arising from certain probation and parole violations by nonviolent offenders.
