LEGISLATIVE COUNSEL'S DIGEST
The California Integrated Waste Management Act of 1989, administered by the Department of Resources Recycling and Recovery, generally regulates the disposal, management, and recycling of solid waste.
The hazardous waste control laws, among other things, vest the Department of Toxic Substances Control with the authority to regulate the generation and disposal of hazardous waste. Existing law authorizes the Department of Toxic Substances Control to adopt regulations to designate end-of-life photovoltaic modules that are identified as hazardous waste as a universal waste and subject those modules to universal waste management.
This bill would require the Secretary for Environmental Protection to, on or before
April 1, 2022, convene the Photovoltaic Recycling Advisory Group, consisting of specified members, to review and advise the Legislature on policies pertaining to the recovery and recycling of photovoltaic panels and their components. The bill would require the advisory group to consult with relevant entities in order to develop and, on or before April 1, 2025, submit to the Legislature policy recommendations aimed at ensuring that, to the extent possible, 100% of photovoltaic panels in the state are reused or recycled at end of life in a safe and cost-effective manner. The bill would make implementation of its provisions contingent upon an appropriation for these purposes in the annual Budget Act or another statute.

The people of the State of California do enact as follows:
SECTION 1.
Section 2006.6 is added to the Streets and Highways Code, to read:2006.6.
Notwithstanding any other law, the Board of Supervisors of the County of Siskiyou may abolish the office of road commissioner if the board transfers all duties of the road commissioner to the county director of the department of public works. The director of that department shall not be required to have any special permit, registration, or license. Any civil engineering functions that are required to be performed by the road commissioner shall be performed by a registered civil engineer acting under the authority of the director of that department.SEC. 2.
The Legislature finds and declares that a special statute is necessary and that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution because of the particular needs of the County of Siskiyou, including difficulty in finding properly qualified candidates for the position of county road commissioner.(a)The Secretary for Environmental Protection shall, on or before April 1, 2022, convene the Photovoltaic Recycling Advisory Group to review and advise the Legislature on policies pertaining to the recovery and recycling of photovoltaic panels and their components.
(b)The Secretary for Environmental Protection shall appoint the following members to the advisory group:
(1)The Director of Resources Recycling and Recovery or their designee.
(2)The Director of Toxic Substances Control or their designee.
(3)A photovoltaic panel or solar energy system manufacturer.
(4)An organization that represents one or more photovoltaic panel manufacturers.
(5)An electronic waste recycler or an organization that represents one or more electronic waste recyclers.
(6)A photovoltaic panel or solar energy system repair dealer or an organization that represents one or more photovoltaic panel or solar energy system repair dealers.
(7)An environmental organization that specializes in waste reduction and recycling.
(8)A representative of the solar industry.
(9)A standards organization that has a focus on photovoltaic or electrical engineering.
(c)The advisory group shall consult with relevant entities in order to develop and, on or before April 1, 2025, submit to the Legislature in compliance with Section 9795 of the Government Code policy recommendations aimed at ensuring that, to the extent possible, 100 percent of photovoltaic panels in the state are reused or recycled at end of life in a safe and cost-effective manner.
(d)Meetings of the advisory group are subject to the Bagley-Keene Open Meeting Act (Article 9 (commencing with Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of the Government Code).
(e)Implementation of this chapter is contingent upon an appropriation for purposes of this chapter in the annual Budget Act or another statute.
(f)This chapter shall remain in effect only until January 1, 2027, and as of that date is repealed.
