An act to amend Section 340 of the Water Code, relating to water.

Water: Yuba River debris control. Disaster Preparedness and Flood Prevention Bond Act of 2006.
Existing law, the Disaster Preparedness and Flood Prevention Bond Act of 2006, authorizes bonds in the amount of $4,090,000,000 for the purposes of financing disaster preparedness and flood prevention projects and makes $3,000,000,000 available, upon appropriation to the Department of Water Resources, for the evaluation, repair, rehabilitation, reconstruction, or replacement of levees, weirs, bypasses, and facilities of the State Plan of Flood Control, for improving or adding facilities to the State Plan of Flood Control to increase levels of flood protection in urban areas, and to reduce the risk of levee failure in the Sacramento-San Joaquin Delta. The Budget Act of 2015 appropriates $192,795,000 to the Department of Water Resources from the Disaster Preparedness and Flood Prevention Bond Fund of 2006
for specified flood protection-related activities, including direct expenditures in cooperation with other agencies.
Of the moneys appropriated to the department by the Budget Act of 2015, the bill would require the department to expend up to $110,000,000 for the upgrade of the levee system of Reclamation District No. 17 to provide the urban level of flood protection.
This bill would make legislative findings and declarations as to the necessity of a special statute for Reclamation District No. 17.
Existing law requires any funds appropriated for Yuba River debris control to be used for construction, renewal, and repair of works for restraining, impounding, and control of debris resulting from mining operations, natural erosion, and other causes.
This bill would make nonsubstantive changes to that provision.

The people of the State of California do enact as follows:
SECTION 1.
Of the moneys appropriated to the Department of Water Resources for support of the Department of Water Resources under Item 3860-001-6052 of the Budget Act of 2015, one hundred ten million dollars ($110,000,000) the department shall expend up to for the upgrade of the levee system of Reclamation District No. 17, consistent with Chapter 1.699 (commencing with Section 5096.800) of Division 5 of the Public Resources Code, to provide the urban level of flood protection.SEC. 2.
The Legislature finds and declares that a special law is necessary and that a general law cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution in order to ensure the protection and safety of the public who live in the flood plain of Reclamation District No. 17.Any funds appropriated for Yuba River debris control shall be used for construction, renewal, and repair of works for restraining, impounding, and control of debris resulting from mining operations, natural erosion, and other causes.
