BILL NUMBER: SB 601 AMENDED BILL TEXT AMENDED IN SENATE MARCH 24, 2011 INTRODUCED BY Senator Hancock FEBRUARY 17, 2011An act relating to corrections.An act to add Section 5055.5 to the Penal Code, relating to prison wardens. LEGISLATIVE COUNSEL'S DIGEST SB 601, as amended, Hancock. Corrections: prisons:budget accountability.warden report card. Existing law provides that the supervision, management, and control of the state prisons, and the responsibility for the care, custody, treatment, training, discipline, and employment of persons confined therein are vested in the Secretary of the Department of Corrections and Rehabilitation. This bill would require the Secretary of the Department of Corrections and Rehabilitation to develop a warden report card containing specified information regarding each warden and the warden' s prison, including, among other information, the number of inmates disciplined and the number of inmate appeals related to disciplinary actions, on a monthly basis and to post the warden report card once a month on the department's Internet Web site.Existing law provides for a system of prisons under the supervision of the Department of Corrections and Rehabilitation. Existing law authorizes the department to contract for provisions, clothing, medicines, forage, fuel, and all other staple supplies needed for the support of the prisons, as specified. Existing law requires the department to provide to the Joint Legislative Budget Committee operational and fiscal information, as specified, no later than January 10 of each year.This bill would declare the intent of the Legislature to enact legislation addressing budget accountability and program accountability for prisons, parole, and juvenile offender operations, and to require the Secretary of the Department of Corrections and Rehabilitation to issue a quarterly, publicly posted report detailing the department's budget by line items, and report on moneys spent for each line item.Vote: majority. Appropriation: no. Fiscal committee:noyes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 5055.5 is added to the Penal Code , to read: 5055.5. (a) The Secretary of the Department of Corrections and Rehabilitation shall develop a warden report card as described in subdivision (b) for each warden on a monthly basis and post the warden report card once a month on the department's Internet Web site. The department shall post both current and all previous monthly warden report cards for each warden on the Internet Web site. (b) Each warden report card shall be created using, when possible, information collected using the Compstat (computer assisted statistics) reports for each prison and shall include, but not be limited to, all of the following information: (1) A brief biography of the warden, whether he or she is an acting or permanent warden, and contact information for the warden. (2) A brief description of the prison and the total number of inmates currently residing at the prison. (3) The number of prisoner incidents at the prison. (4) The number of inmates disciplined. (5) The number of inmate appeals of disciplinary actions. (6) Academic programs, including capacity, enrollment, attendance, waiting lists, if any, and number of programs completed. (7) Inmate reading levels. (8) Vocational programs, including capacity, enrollment, waiting lists, if any, and program outcomes. (9) Substance abuse and treatment programs, including the number of beds, the percentage of beds occupied, the number of meetings held, and the attendance at those meetings. (10) The number of staff vacancies. (11) Overtime and sick leave totals. (12) The number of workers compensation claims, including the number of staff persons on leave due to accepted or pending claims. (13) Work orders for repairs. (14) The adverse actions regarding staff. (15) Contraband seized. (16) The budget for the prison, including whether the operations are under or over budget.SECTION 1.It is the intent of the Legislature to enact legislation addressing budget accountability and program accountability for prison, parole, and juvenile offender operations, and to require the Secretary of the Department of Corrections and Rehabilitation to issue a quarterly, publicly posted report detailing the department's budget by line items, and report on moneys spent for each line item.
