BILL NUMBER: SB 960	INTRODUCED
	BILL TEXT

INTRODUCED BY Senator Rubio

                        JANUARY 10, 2012

An act to add Section 89711 to the Education Code, relating to the
California State University.

	LEGISLATIVE COUNSEL'S DIGEST

SB 960, as introduced, Rubio. California State University:
campus-based mandatory fees.
Existing law establishes the California State University, under
the administration of the Trustees of the California State
University, as one of the segments of public postsecondary education
in the state. Existing law authorizes the trustees by rule to require
all persons to pay fees, rents, deposits, and charges for services,
facilities, or materials provided by the trustees to such persons.
This bill would prohibit specified California State University
campus-based mandatory fees from being established, adjusted, or
reallocated without consideration by the applicable campus fee
advisory committee and a vote of the student body. The bill would
also prohibit the California State University Mandatory Catalog from
providing authority to campus presidents to use alternative
consultation mechanisms to establish, adjust, or reallocate those
campus-based mandatory fees without consideration by the applicable
campus fee advisory committee and a vote of the student body.
Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

SECTION 1. Section 89711 is added to the Education Code, to read:

fees that are not specifically authorized by statute shall not be
established without consideration by the applicable campus fee
advisory committee and a vote of the student body.
   (b) California State University campus-based mandatory fees that
are established through a vote of the student body, but not
specifically authorized by statute, shall not be adjusted or
reallocated without consideration by the applicable campus fee
advisory committee and a vote of the student body.
   (c) The California State University Mandatory Catalog shall not
provide authority to campus presidents to use alternative
consultation mechanisms to establish, adjust, or reallocate the
campus-based mandatory fees referenced in subdivisions (a) and (b)
without consideration by the applicable campus fee advisory committee
and a vote of the student body.
