bill would include findings that changes proposed by this bill address a matter of statewide concern rather than a municipal affair and, therefore, apply to all cities, including charter cities.

The people of the State of California do enact as follows:
SECTION 1.
The Legislature finds and declares all of the following:SEC. 2.
Section 25239 is added to the Public Resources Code, to read:25239.
(a) For purposes of this section, the following definitions apply:(d)Between January 1, 2025 and the date of the completion of the
study and the submission of the report to Legislature pursuant to subdivision (c), a local government, including a charter city, shall not ban the construction or maintenance of retail gasoline fueling stations or alternative fuel infrastructure.
(e)
The Legislature finds and declares that Section 2 of the bill addresses a matter of statewide concern rather than a municipal affair as that term is used in Section 5 of Article XI of the California Constitution. Therefore, Section 2 of this bill applies to all cities, including charter cities.
