AN ACT REQUIRING CERTIFICATE OF NEED APPROVAL FOR THE TERMINATION OF INPATIENT AND OUTPATIENT SERVICES BY A HOSPITAL.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That section 19a-638 of the general statutes be amended to require that: (1) Any hospital seeking to terminate inpatient or outpatient services offered by such hospital shall pursue and obtain certificate of need approval from the Office of Health Care Access division within the Department of Public Health prior to terminating such services; and (2) the Office of Health Care Access division within the Department of Public Health shall conduct a public hearing on any request from a hospital seeking to terminate inpatient or outpatient hospital services prior to acting on such request.

Statement of Purpose:

To ensure that the oversight role of the Office of Health Care Access is maintained by requiring a hospital seeking to terminate inpatient or outpatient services offered by such hospital to pursue and obtain certificate of need approval from the office prior to terminating such services and require the office to hold a public hearing on such requests to ensure transparency in the process prior to the office taking any action of the request.
