AN ACT CONCERNING REFUSE REMOVAL OR DISPOSAL CONTRACT RENEWALS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2011) No contract for refuse removal or disposal which contains a renewal provision of one year or more shall be enforceable unless the provider of such refuse removal or disposal services has sent written notice of such contract renewal to the customer not later than ninety days prior to the expiration date of the contract being renewed. Such written notice shall provide the customer with the opportunity to cancel such refuse removal or disposal contract at the end of the initial contract term. No such renewal provision shall be enforceable unless the customer agrees to such renewal, in writing, after receiving such written notice.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To provide refuse removal and disposal company customers fair notice and the option to cancel contract renewals.
