AN ACT CONCERNING MEDICAID APPLICATIONS BY MARRIED PERSONS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (Effective from passage) (a) Not later than February 1, 2015, the Commissioner of Social Services shall, in accordance with the provisions of section 11-4a of the general statutes, report to the Commissioner on Aging and the joint standing committees of the General Assembly having cognizance of matters relating to aging and human services data concerning married persons who have applied for Medicaid during the calendar year ending December 31, 2014. The Commissioner of Social Services shall include in the report:

(1) The total number of married persons who applied for Medicaid;

(2) The combined marital assets of each married person who applies for Medicaid and his or her spouse;

(3) Separate totals for each spouse of non-exempt assets and exempt assets under Medicaid income eligibility rules;

(4) The dollar amount that the spouse of an institutionalized person was allowed to keep under the community spouse protected amount formula pursuant to 42 USC 1396r-5(f)(2);

(5) The number of days that elapsed from the date of a married person's application for Medicaid to a determination of Medicaid eligibility;

(6) The number and outcome of administrative appeals filed by or on behalf of such married couples seeking (A) enhancement of the community spouse protected amount, and (B) substantiation of the community spouse protected amount;

(7) The number of fair hearings conducted pursuant to section 17b-60 of the general statutes concerning the community spouse's income amount based upon (A) the formula for housing costs of the community spouse, and (B) the low income of the community spouse; and

(8) The average number of staff hours spent evaluating applications for the determination of spousal assets and calculating the community spouse's protected amount.

(b) The commissioner shall ensure that the report filed pursuant to subsection (a) of this section does not contain the names, addresses or personally identifiable information of any couple whose data is included.

This act shall take effect as follows and shall amend the following sections:
