AN ACT CONCERNING WORKPLACE VIOLENCE PREVENTION AND REPORTING.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 19a-490s of the 2012 supplement to the general statutes is repealed and the following is substituted in lieu thereof (Effective from passage):

(a) For purposes of this section:

(1) "Act of violence" means (A) a physical attack, with or without a weapon, that results in a person's death, loss of consciousness, physical injury that requires medical treatment beyond first aid, or which impedes a person's breathing or blood circulation as a result of restraint by the neck or throat; or (B) a verbal threat of an act described in subparagraph (A) of this subdivision that a health care employer reasonably believes is real, immediate and capable of being carried out by the person making the threat; and

(2) "Medical treatment beyond first aid" shall have the same meaning as described in 29 CFR 1904.7(b)(5), as amended from time to time.

(b) Except as provided in this section, a health care employer shall report to such employer's local law enforcement agency any act [which may constitute an assault or related offense, as described in part V of chapter 952,] of violence against a health care employee acting in the performance of his or her duties. A health care employer shall make such report not later than twenty-four hours after the occurrence of the act of violence. The health care employer shall provide the names and addresses of those involved with such act of violence to the local law enforcement agency. A health care employer may, but shall not be required to, report any act [which may constitute assault or a related offense if the act was] of violence committed by a person with a disability as described in subdivision (13), (15) or (20) of section 46a-51 whose conduct is a clear and direct manifestation of the disability.
