AN ACT CONCERNING INSURANCE COVERAGE FOR ACUPUNCTURE TREATMENTS PROVIDED BY CHIROPRACTORS AND THE MINIMUM PROFESSIONAL LIABILITY INSURANCE CARRIED BY CHIROPRACTORS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. Section 38a-507 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2011):

[Every] Each individual health insurance policy delivered, issued for delivery, [or] renewed, amended or continued in this state [on or after October 1, 1989,] shall provide coverage for: [services]

(1) Services rendered by a chiropractor licensed under chapter 372 to the same extent coverage is provided for services rendered by a physician, if such chiropractic services [(1)] (A) treat a condition covered under such policy, and [(2)] (B) are within those services a chiropractor is licensed to perform; and

(2) Acupuncture treatments provided by such chiropractor.

Sec. 2. Section 38a-534 of the general statutes is repealed and the following is substituted in lieu thereof (Effective January 1, 2011):

[Every] Each group health insurance policy providing coverage of the type specified in subdivisions (1), (2), (4), (6) and (11) of section 38a-469, delivered, issued for delivery, [or] renewed, amended or continued in this state [on or after October 1, 1989,] shall provide coverage for: [services]

(1) Services rendered by a chiropractor licensed under chapter 372 to the same extent coverage is provided for services rendered by a physician, if such chiropractic services [(1)] (A) treat a condition covered under such policy, and [(2)] (B) are within those services a chiropractor is licensed to perform; and

(2) Acupuncture treatments provided by such chiropractor.

Sec. 3. Subsection (a) of section 20-28b of the general statutes is repealed and the following is substituted in lieu thereof (Effective October 1, 2010):

(a) Each person licensed to practice chiropractic under the provisions of section 20-27 who provides direct patient care services shall maintain professional liability insurance or other indemnity against liability for professional malpractice. The amount of insurance which each such person shall carry as insurance or indemnity against claims for injury or death for professional malpractice shall not be less than [five hundred thousand] one million dollars for one person, per occurrence, with an aggregate of not less than [one million five hundred thousand] three million dollars.

This act shall take effect as follows and shall amend the following sections:

Statement of Purpose:

To require health insurance coverage for acupuncture treatments provided by a chiropractor and to increase the minimum amount of professional liability insurance a person licensed to practice chiropractic is required to carry.
