Summary
Since at least the 1980s, the Supreme Court has occasionally heard argument in locations other than Dover when time exigencies or special circumstances (such as the educational value of holding arguments at a law school) justified a departure from holding argument in Dover. To ensure that this long-standing practice is consistent with the Code, this Act would specifically authorize such limited exceptions to the general rule that the Supreme Court hears arguments in Dover. In emergency situations, the Chief Justice is authorized to determine if it is necessary for the Court to conduct proceedings outside of Dover; in all other circumstances, the Chief Justice, in consultation with the Justices, will determine whether the Court should hold a special session in another location for the benefit of the Bar, law students or in the public interest.
