Summary

This legislation recognizes that one of the consequences of crime is that employees of the Department of Justice are required to prosecute the offenses. When a defendant is held to be responsible for an offense, requiring the defendant to make a payment acknowledging the cost to the State serves the purposes of the criminal justice system. In addition, the courts are given discretion to reduce or waive the fee when the defendant timely acknowledges responsibility for an offense. Such timely acknowledgement reduces the actual costs to the Department of Justice.
