Summary
On December 22, 2008, Delaware City Fire Company paramedic Michelle Smith was tragically killed in the line of duty by a reckless driver. Under current Delaware law, a person who recklessly causes the death of an on-duty law enforcement officer, corrections employee or fire fighter is guilty of murder in the first degree and eligible for capital punishment. This Act, named in Michelle’s honor, adds paramedics, EMTs, Fire Marshalls and fire police officers to same statutes, ensuring that any person who recklessly kills one of Delaware’s first responders is eligible to be punished to the fullest extent of the law
