Summary
This Bill incorporates all of the changes recommended by the Joint Sunset Committee following its review of the Board of Dental Examiners. The Bill: 1) Gives the Board the power to subpoena records of hospitals as the Committee has done for the Board of Medical Practice; 2) Requires an applicant to affirm at the time of application that he/she is physically and mentally capable to engage in the practice of dentistry, and to submit to such examinations as deemed necessary to determine the applicant’s capability; 3) Clarifies that a licensee who fails to renew on or before the renewal date, and any allowable extension, not to exceed 1 year, will be considered a new applicant; 4) Increases the monetary penalties for disciplinary actions and penalties; 5) Gives the Board the authority to determine, after a hearing, whether administrative penalties are grounds to deny licensure. This discretion to license after a hearing is language consistent with other Title 24 boards and commissions. 6) Grants the Board the authority to conduct criminal background checks for applicants. 7) Includes a duty to report as is included in the Medical Practices Act; 8) Provides that the Dental Hygiene Advisory Committee can also vote with the Board in disciplinary actions involving hygienistsand on other matters involving the policy and practice of dental hygiene as defined in statute and further defined in the Board’s rules and regulations. The Committee shall not vote on matters involving changing the scope of practice as defined in statute. 9) Provides definitions for “dental technician,” “dental assistant” and “dental auxiliary personnel;” 10) Deletes the sunset provision for Out-of-State Volunteer Licensure; 11) Provides that a dentist and a dental hygienist from the same practice, or two dentists from the same practice, or two dental hygienists from the same practice may not serve on the Board or the Dental Hygiene Advisory Committee at the same time; and 12) Changes the name of the State Board of Dental Examiners to the State Board of Dentistry and Dental Hygiene.
