Summary

This legislation represents the work of the HJR 17 Study Group created to review Delaware’s civil mental health laws. HJR17 required a report and recommendation on immunity provisions of 16 Del. C. 5122(j) and 5004(f) by January 1, 2013. This is the proposal that resulted from the work of the HJR17 Study Group and is a consensus recommendation from the diverse stakeholders. This bill clarifies the law on immunity as regards the process to detain or not detain a person for an involuntary mental health evaluation. Medical negligence claims arising after the mental health assessment and resulting clinical decision to detain and claims unrelated to mental health are not intended to be included in the immunity protection.
