Summary
The Truth-in-Sentencing Act of 1989, 67 Del. Laws, c. 130, abolished parole in Delaware, but it also allowed inmates to work toward an early release by earning “good time” credits for good behavior and participating in programming. However, the amount of credits that an inmate can earn is strictly limited, and inmates are generally not able to reduce their prison time by more than a small fraction of the original sentence. This Act leaves intact the current limits on good time credits for the most serious offenders; however, it raises the limits for inmates who committed lesser offenses. The purpose of raising the limits is to allow low-to-medium risk inmates who have demonstrated an exceptional level of rehabilitation and improvement during their time in prison to earn additional credits and work toward an earlier release.
