Summary
This Act will protect the safety of certain victims of violent crime by creating Delaware’s Address Confidentiality Program, which will be administered by the Delaware Department of Justice. The Program will permit victims of crime of domestic violence, stalking and sexual assault, as well as persons participating in Delaware’s Witness Protection Program, to keep their actual address confidential by applying to the Department of Justice for a substitute address to which all mail will be delivered. The Act requires any Federal, State or local governmental agency to accept a program participant’s substitute address, except as necessary to comply with the terms of court-ordered probation, parole, pre-trial release or sex offender registration. The Act ensures that Federal, State and local governments, will have access to a program participant’s actual address through a waiver process to be established by the Department of Justice. Disclosure of a participant’s actual address to a law enforcement agency in an emergency situation or as directed by court order will also be required by the Act. The Act also establishes that program participants may utilize the existing provisions of the Delaware Code to request that the Department of Elections maintain the confidentiality of their actual address. The Act shall take effect on October 3, 2011.
