HOUSE BILL NO. 298

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO RULES OF THE ROAD AND CELL TELEPHONE USAGE.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 41, Title 21 of the Delaware Code by adding a new section to read as follows:

"§ 4176C.Hand held cell telephone use prohibited.

(a) No driver shall operate a motor vehicle on any highway while using a hand held cell telephone while the vehicle is in motion.

(b) ‘Cell telephone' means a cellular, analog, wireless or digital telephone.

(c) This section shall not apply to law enforcement emergency personnel in the performance of their duties or to drivers operating a school bus that are subject to §4176B of this Chapter.

(d) A violation of this section shall be subject to a $50.00 civil penalty for the first violation and a $100.00 civil penalty for each subsequent violation.".

Section 2.This Act shall become effective 90 days after its enactment.


SYNOPSIS

This Bill prohibits the use of hand held cell telephones by the driver of a motor vehicle while the vehicle is in motion on Delaware highways.A civil penalty is created.
