HOUSE BILL NO. 437

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO THE REGISTRATION OF VEHICLES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 2139F, Title 21 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 2139F. Special animal welfare license plates.

(a) The owner of any vehicle described in paragraph (b) of this subsection may apply to the Department for the assignment to that vehicle of a special animal welfare registration.

(b) This section applies only to:

(1) A private passenger vehicle; or

(2) A truck or trailer with a 3/4-ton or smaller manufacturer's rated capacity manufacturer’s gross vehicle weight rating (GVWR) of 26,000 pounds or less .

Section 2. Amend § 2139H, Title 21 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 2139H. Farmland preservation plates.

(a) The owner of any vehicle described in subsection (b) of this section may apply to the Division of Motor Vehicles for a special "Farmland Preservation" registration plate.

(b) This section applies to:

(1) A private passenger vehicle; or

(2) A truck or trailer with a 3/4-ton or smaller manufacturer's rated capacity manufacturer’s gross ehicle weight rating (GVWR) of 26,000 pounts or less .

Section 3. Amend § 2139O, Title 21 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 2139O. Marine Education, Research and Rehabilitation Institute, Inc. special license plates.

(a) The owner of a motor vehicle which is a private passenger vehicle or a truck or trailer with a 3/4-ton or smaller manufacturer's rated capacity manufacturer’s gross vehicle weight rating (GVWR) of 26,000 pounds or less may apply to the Division of Motor Vehicles for a special Marine Education.

Section 4. Amend § 2139W, Title 21 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 2139W. Special license plates for the Delaware Equine Council.

(a) The owner of any vehicle described in subsection (b) of this section may apply to the Division of Motor Vehicles for a special Delaware Equine Council registration plate.

(b) This section applies only to:

(1) A private passenger vehicle; or

(2) A truck or trailer with a 3/4-ton or less manufacturer's rated capacity manufacturer’s gross vehicle weight rating (GVWR) of 26,000 pounds or less ; or

Section 5. Amend § 2139Z, Title 21 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underline as follows:

§ 2139Z. Special license plates for Keep Delaware Beautiful.

(a) The owner of any vehicle described in subsection (b) of this section may apply to the Department for the assignment to that vehicle of a special Keep Delaware Beautiful registration.

(b) This section applies only to:

(1) A private passenger vehicle; or

(2) A truck or trailer with a ¾ ton or smaller manufacturer’s rated capacity manufacturer’s gross vehicle weight rating (GVWR) of 26,000 pounds or less .

SYNOPSIS

This bill allows the background plates (animal welfare, farmland preservation, Marine Education Research and Rehabilitation Institute, Delaware Equine Council, and Keep Delaware Beautiful) issued by DMV to be displayed on trailers up to 26,000 pounds gross vehicle weight rating (GVWR). It also increases the size of trucks that can display the plates from ¾ ton (10,000 pounds GVWR) to 26,000 pounds GVWR.
