AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO THE "MOVE OVER" LAW. |
Section 1.Amend §4131(b) of Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§4134 Operation of vehicles on approach of authorized emergency vehicles
(b)Upon approaching a stationary authorized emergency vehicle, when the authorized emergency vehicle is giving a signal by displaying alternately flashing red, blue, blue and white, red and white, red and blue, or red, white and blue lights, or upon approaching a stationary authorized vehicle of the Department of Transportation, which is giving a signal by displaying alternately flashing amber or red and amber lights, or upon approaching a stationary tow truck, which is giving a signal by displaying alternately flashing amber, white, or amber and white lights, or upon approaching a stationary vehicle owned or operated by a public utility, which is marked by at least one traffic cone on each side of the vehicle, a person who drives an approaching vehicle shall:
SYNOPSIS
This bill amends Delaware's version of the "Move Over Law" by including vehicles owned or operated by a public utility, as defined under 26 Del.C., §102(2), that are performing roadside work, provided they have properly surrounded the vehicle with traffic cones.This will afford the same protection offered to Emergency vehicles and Tow Trucks under the existing law, but would not require utility vehicles to install and utilize signal lighting on its vehicles. |
